Terms of Use
The rules and agreement that govern your use of the site.

These Terms of Use ("Terms") govern your use of rivals.sportscafe.media and related services (the "Site"), operated by Sports Cafe Media ("Rivals", "we", "us", "our"). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please stop using the Site.
Nothing in these Terms excludes, restricts, or modifies any rights you have that cannot be lawfully excluded, including your rights under the Australian Consumer Law.
1. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Site. If you are under 18, you must have a parent or legal guardian's consent. By using the Site you represent that you meet these requirements and that the information you provide is accurate.
2. Your account
You can create an account to access paid membership content, buy merchandise, or participate in any features that require sign-in. You agree to provide accurate and current information, keep your login credentials secure, take responsibility for all activity under your account, notify us promptly at hello@rivals.sportscafe.media if you suspect unauthorized access, and not share, sell, sublicense, or transfer your account or membership.
We may suspend or terminate accounts that breach these Terms or appear to pose a risk to the Site, other users, or us.
3. Memberships
3.1 Subscription
A Rivals membership provides access to members-only episodes, behind-the-scenes content, early merch drops with member discounts, and any other benefits we add from time to time. Benefits may change; we will give reasonable notice of material changes.
3.2 Billing
Membership is billed monthly at the price displayed at checkout (currently AUD $10/month, including GST where applicable). Billing is processed by Stripe, via our authentication partner Clerk. By subscribing, you authorize recurring charges at the stated price until you cancel.
3.3 Auto-renewal
Your subscription automatically renews at the end of each billing period at the then-current price. You can cancel at any time from your account settings before the next renewal date.
3.4 Cancellation
You can cancel your membership at any time from your account settings. Your membership will continue until the end of the current billing period, and you will not be charged again. You retain access to members-only content until the end of that period.
3.5 Refunds
Memberships are non-refundable except where required by law (including the Australian Consumer Law). If you believe you have been charged in error or you are entitled to a refund under applicable consumer law, email hello@rivals.sportscafe.media within 30 days of the charge and we will review your request promptly.
3.6 Price changes
We may change the membership price. Price changes only take effect at the start of your next billing period, and we will give you at least 30 days' notice by email. If you do not agree to the new price, cancel before the change takes effect.
4. Shop purchases
Physical merchandise is sold through our partner Shopify. Orders, payment, fulfillment, shipping, returns, and warranty matters are governed by Shopify's terms, our Shop Terms, and the Shipping Policy presented at checkout. Nothing in these Terms limits your rights under the Australian Consumer Law, including your rights to a refund, replacement, or repair for faulty goods.
5. Content
5.1 Our content
Rivals owns or licenses all content on the Site, including text, audio, video, images, logos, podcasts, graphics, code, and the overall look and feel ("Our Content"). Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and view Our Content for your personal, non-commercial use.
You may not copy, reproduce, distribute, publicly display, republish, or re-upload Our Content; modify, adapt, translate, reverse engineer, decompile, or create derivative works based on Our Content; re-upload episodes or clips to other platforms without our written permission; use Our Content to train artificial intelligence, machine learning, or similar models; or use Our Content for any commercial purpose.
Embedding YouTube episodes using YouTube's official embed feature is permitted.
5.2 Your content
If you submit content to us — including comments, tips, questions, messages, or any material sent through the Site or to our email addresses — you grant Rivals a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and display that content in any media, in connection with the Site, our podcast, and our marketing.
You represent and warrant that you own or have the right to submit the content, that the content does not violate anyone's intellectual property or privacy rights, and that it does not violate any law.
6. Acceptable use
You agree not to use the Site for any illegal, fraudulent, or unauthorized purpose; attempt to interfere with, disable, damage, or disrupt the Site or its infrastructure; access the Site through automated means (bots, scrapers, crawlers) except for legitimate search engine indexing; circumvent any access controls, paywalls, or rate limits; impersonate any person or entity or misrepresent your affiliation; harass, threaten, defame, or harm others; upload or transmit viruses, malware, or any harmful code; or collect information about other users without their consent.
7. Third-party services and links
The Site uses and links to third-party services, including Clerk, Stripe, Shopify, YouTube, Sanity, Resend, Google Analytics, and Vercel. We do not control these services and are not responsible for their content, terms, availability, or privacy practices. Your use of a third-party service is governed by that provider's own terms and privacy policy.
8. Disclaimers
The Site and all content on it are provided "as is" and "as available". To the maximum extent permitted by law, Rivals disclaims all warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, and accuracy.
Opinions expressed on the podcast, blog, and Site are those of the hosts, guests, and contributors and do not constitute financial, medical, legal, or professional advice. Do not rely on any content on the Site as a substitute for advice from a qualified professional.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other laws that cannot be lawfully excluded.
9. Limitation of liability
To the maximum extent permitted by law, in no event will Rivals, its affiliates, directors, employees, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Site, even if we were advised of the possibility of such damages.
Where our liability cannot be excluded but can be limited, our total aggregate liability to you for any and all claims arising out of or relating to the Site or these Terms is limited to the greater of (a) the total amount you have paid us in the 12 months immediately before the event giving rise to the claim, or (b) AUD $100.
10. Indemnification
You agree to indemnify, defend, and hold harmless Rivals and its affiliates, directors, employees, and contractors from any claim, loss, damage, liability, or expense (including reasonable legal fees) arising out of or related to your breach of these Terms, your violation of any law, or your infringement of anyone's rights.
11. Termination
We may suspend or terminate your access to the Site, or any part of it, at any time, with or without notice, if we reasonably believe you have breached these Terms or are posing a risk to the Site or other users. You may stop using the Site at any time. Sections that by their nature should survive termination, including sections 5, 8, 9, 10, and 13, will survive.
12. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified by email or a notice on the Site at least 30 days before they take effect. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms. If you do not agree to a change, stop using the Site before it takes effect.
13. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict-of-laws rules. You and Rivals agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia for any dispute that cannot be resolved informally, except where you have a statutory right to bring proceedings in another jurisdiction that cannot be excluded.
Before filing any claim, we ask that you email hello@rivals.sportscafe.media so we can try to resolve the matter with you in good faith.
14. General
Entire agreement. These Terms, together with our Privacy Policy and any other notice or policy displayed on the Site, constitute the entire agreement between you and Rivals regarding the Site and supersede any prior agreements.
Severability. If any part of these Terms is held to be unenforceable, the remainder continues in full force.
No waiver. Our failure to enforce any provision does not waive our right to enforce it later.
Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for any delay or failure to perform caused by events outside its reasonable control.
